Welcome to Alice Care. These Terms of Service ("Terms") govern your
use of the Alice Care mobile application and web platform
(collectively, the "Service") operated by Alice Care ("we," "our," or
"us"). By accessing or using our Service, you agree to be bound by
these Terms.
IMPORTANT MEDICAL DISCLAIMER: Alice Care is a
treatment management tool and does NOT provide medical advice,
diagnosis, or treatment. Always consult your healthcare provider for
medical decisions. In case of a severe allergic reaction or emergency,
call 911 or your local emergency services immediately.
1. Acceptance of Terms
By creating an account or using the Service, you confirm that:

You are at least 18 years old, or you are a parent/legal guardian
registering on behalf of a minor
- You have the legal authority to agree to these Terms

You will use the Service in compliance with all applicable laws and
regulations
If you do not agree to these Terms, please do not use the Service.
2. Description of Service
Alice Care is a healthcare management platform designed to support
Oral Immunotherapy (OIT) treatment by providing:

Dose Tracking: Log and monitor daily OIT doses

Reaction Logging: Record and track allergic
reactions and symptoms

Treatment Protocols: View and follow prescribed
treatment schedules

Care Coordination: Connect patients, caregivers,
and healthcare providers
-
Appointment Management: Schedule and manage clinic
visits
-
Clinical Dashboard: Tools for healthcare providers
to monitor patient progress

Ask Alice (AI Assistant): Optional, opt-in
AI-powered chat that answers questions about OIT and your child's
treatment, powered by AI

AI-Generated Summaries: Optional, opt-in treatment
summaries generated by AI for parents and clinicians
3. User Accounts
3.1 Account Creation
To use the Service, you must create an account and provide accurate,
complete information. You are responsible for maintaining the
confidentiality of your account credentials.
3.2 Account Types

Parent/Guardian: Primary account holder for a
patient, with full access to manage treatment data

Caregiver: Invited by parents with delegated access
(view-only or edit permissions)

Healthcare Provider: Licensed doctors and nurse
practitioners who manage patient treatment

Administrator: System administrators with account
management capabilities
3.3 Account Security
You agree to:
- Keep your login credentials secure and confidential

Notify us immediately of any unauthorized access to your account
- Log out of your account when using shared devices
- Not share your account with unauthorized individuals
3.4 Complimentary Alice Pro Trial
New family accounts receive a complimentary 14-day trial of Alice
Pro, our premium tier, at no cost. No payment information is
collected to start the trial, and the trial does not automatically
convert into a paid subscription when it ends. At the end of the
trial, your account reverts to the free tier and premium features
become unavailable unless you choose to subscribe through the
in-app purchase flow. The trial is limited to one per email
address; deleting and recreating an account does not grant an
additional trial. We reserve the right to modify or discontinue
the complimentary trial at any time, including for new accounts.
4. Healthcare Provider Terms
Healthcare providers using the Service additionally agree to:

Maintain valid medical licenses in their practicing jurisdiction

Use the Service in accordance with applicable medical practice
standards
- Comply with HIPAA and other healthcare privacy regulations
- Not rely solely on the Service for clinical decision-making
- Maintain appropriate malpractice insurance
5. User Responsibilities
5.1 Accurate Information
You are responsible for ensuring that all information you enter into
the Service is accurate and up-to-date. Inaccurate dose or reaction
logging could impact medical care decisions.
5.2 Prohibited Conduct
You agree NOT to:
- Use the Service for any unlawful purpose

Attempt to gain unauthorized access to other users' accounts or data
- Interfere with or disrupt the Service or its servers
- Upload malicious code, viruses, or harmful content
- Impersonate another person or entity
- Use the Service to harass, abuse, or harm others

Post or transmit any content that is unlawful, harassing, abusive,
defamatory, threatening, hateful, sexually explicit, or otherwise
objectionable

Share personally identifying information (yours or anyone else's),
including full names, contact information, insurance identifiers, or
medical record numbers, in public-facing community content

Reverse engineer or attempt to extract source code from the Service
-
Use automated systems to access the Service without permission
Zero tolerance: Alice Care has
no tolerance for objectionable content or abusive
users. Violations may result in immediate removal of content,
suspension, or permanent termination of your account.
5.3 User-Generated Content (Community)
The Service includes a community feature where users may post
questions, tips, and stories ("User Content"). By posting User
Content, you agree to the following:

Ownership and license: You retain ownership of your
User Content. You grant Alice Care a non-exclusive, worldwide,
royalty-free license to host, display, store, and distribute your
User Content within the Service for the purpose of operating the
community feature.

Standards: User Content must comply with the
prohibited-conduct rules in Section 5.2 and our community
guidelines, which you accept the first time you contribute a post or
comment.

Automated and human moderation: User Content is
reviewed by automated content-classification systems and may be
reviewed by human moderators. Content that violates these Terms or
our community guidelines will be removed.

Your reporting and removal tools: You may flag any
post or comment for review using the in-app report action. You may
delete your own posts and comments at any time. You may block other
users to prevent their content from appearing in your feed.

Our response commitment: We aim to review reports
of objectionable User Content within twenty-four (24) hours and to
remove offending content and eject users responsible for repeated
violations.

How to report abuse: In addition to the in-app
report action, you may contact us directly at
support@alicecare.health
to report inappropriate activity, request removal of content, or
raise safety concerns.

No medical advice in community posts: User Content
is generated by other parents and caregivers and does not constitute
medical advice. Do not act on community posts in lieu of guidance
from your healthcare provider.
6. Medical Disclaimer
THE SERVICE IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE,
DIAGNOSIS, OR TREATMENT.

Alice Care is a tool to help track and manage OIT treatment under
the supervision of qualified healthcare providers

Always follow your healthcare provider's instructions regarding
dosing and treatment

Never delay seeking medical attention based on information from this
Service

In case of severe allergic reaction (anaphylaxis), administer
epinephrine if prescribed and call emergency services immediately
-
We are not responsible for any health decisions made based on
Service data
7. Intellectual Property
The Service, including its design, features, content, and underlying
technology, is owned by Alice Care and protected by intellectual
property laws. You are granted a limited, non-exclusive,
non-transferable license to use the Service for its intended purpose.
You retain ownership of any content you submit to the Service, but
grant us a license to use, store, and process that content to provide
the Service.
8. Privacy
Your use of the Service is also governed by our
Privacy Policy, which describes how we collect,
use, and protect your information, including Protected Health
Information (PHI). By using the Service, you consent to the practices
described in the Privacy Policy.
9. Third-Party Services and AI
The Service integrates with third-party services to provide certain
features. We are not responsible for the content, privacy practices,
or availability of these services.
9.1 AI Services
The Ask Alice assistant and treatment-summary features are powered by
a third-party AI provider. AI features are optional and require your
explicit consent before any data is sent. See our
Privacy Policy, Section 3.5, for the named
subprocessors currently in use and details about what data is shared,
how it is used, and how to revoke consent.
9.2 Other Integrations
The Service may also integrate with or contain links to other
third-party services, such as calendar applications or cloud storage.
Use of those services is governed by their own terms and privacy
policies.
10. Service Availability
We strive to maintain high availability of the Service but do not
guarantee uninterrupted access. The Service may be temporarily
unavailable due to:

Scheduled maintenance (we will provide advance notice when possible)
- Emergency repairs or updates
-
Factors beyond our control (internet outages, natural disasters,
etc.)
Important: Because the Service may not always be
available, you should not rely solely on it for critical medical
reminders. Always have backup methods to track doses and appointments.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND,
EXPRESS OR IMPLIED

WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR
UNINTERRUPTED

WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL,
CONSEQUENTIAL, OR PUNITIVE DAMAGES

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE
SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS
PRECEDING THE CLAIM
12. Indemnification
You agree to indemnify and hold harmless Alice Care, its officers,
directors, employees, and agents from any claims, damages, losses, or
expenses (including reasonable attorneys' fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you submit to the Service
13. Termination
13.1 By You
You may stop using the Service and request account deletion at any
time by contacting us. Note that certain data may be retained as
required by HIPAA and other regulations.
13.2 By Us
We may suspend or terminate your access to the Service if:
- You violate these Terms
- Your use poses a security risk to the Service or other users
- Required by law
- We discontinue the Service (with reasonable notice)
14. Changes to Terms
We may modify these Terms at any time. We will notify you of material
changes by posting the updated Terms in the app and updating the "Last
Updated" date. Your continued use of the Service after changes
constitutes acceptance of the modified Terms.
15. Dispute Resolution
Any disputes arising from these Terms or your use of the Service will
be resolved as follows:

Informal Resolution: We encourage you to contact us
first to resolve any issues informally

Governing Law: These Terms are governed by the laws
of the State of Florida, without regard to conflict of law
principles

Jurisdiction: Any legal proceedings shall be
brought in the courts located in Broward County, Florida
16. General Provisions

Entire Agreement: These Terms, together with our
Privacy Policy, constitute the entire agreement between you and
Alice Care

Severability: If any provision is found
unenforceable, the remaining provisions will continue in effect

Waiver: Our failure to enforce any right or
provision does not constitute a waiver

Assignment: You may not assign your rights under
these Terms without our consent
